MMT Privacy Policy

 
Manufacture Modules Technologies Sàrl, domiciled in Plan-les-Ouates, Geneva ("MMT") provides services related to its smartwatch technology with certain activity tracking functionalities via devices, applications and websites (the "MMT-System"). MMT receives and collects data from and about users through a smartwatch connected to the MMT-System (the "Smartwatch"), the MMT-System mobile or web application (the "App"), as well as mobile sites and websites that users can access with their Smartwatch and the App (the "Websites").
 
At MMT we highly value your privacy and adhere to the applicable privacy laws when collecting and processing your data. This Privacy Policy outlines the principles of data collection and processing for the MMT-System, the Smartwatch, the App and the Websites by MMT./div>

1. Collecting Information

When downloading the App, registering for an account, connecting your Smartwatch to your account, or generally using the MMT-System, we may ask you to provide certain personal information such as first and last name, email address, an account name and password. Depending on the functionalities you choose to use, you may provide us with other information such as birth date, height, gender, and other personal information.
 
When registering for the MMT-System and using our App, we also receive information from you about your Smartwatch, including your Smartwatch type, manufacturer, model, and your unique Smartwatch identification number.
 
When connecting and synchronising your Smartwatch, it automatically transmits activity and physical information to us depending on the functionalities activated. Such information may include information about activities such as sleeping and walking based on your Smartwatch monitoring micro movements. Your Smartwatch and the App may also transmit precise location data.

2. MMT Use of Information

We use the information collected to provide our services to you and enable you to use the MMTSystem. Further we use such information to provide our customer service to you or to send you nonpromotional email or correspondence about your account or your business dealings with MMT. We also use the information to improve the MMT-System and protect it against fraudulent, unauthorized or illegal activities. For this purpose we may also share your personal information collected through the MMT-System with the maker/seller of your Smartwatch.
 
We will only send you promotional emails or correspondence with your prior consent (opt-in).
 
We do not rent, sell or otherwise share your individual personal information with third parties, except with your consent, for example to connect with a third party app or service. Further we may use service providers to help us deliver our service and run or analyse the MMT-System (e.g. third party data analytics services to analyse, among other things, server load and app behaviour).
 
Further, we reserve the right to share your personal information for the purposes of a business deal (or negotiation of a business deal) involving sale or transfer of all or a part of our business or assets. These deals may include, but is not limited to, a merger, financing, or acquisition.
 
We also reserve the right to disclose your personal information to (a) comply with relevant laws, regulatory requirements and to respond to lawful requests, court orders, and legal process; (b) to protect and defend the rights or property of us or third parties, including enforcing agreements, policies, and terms of use; (c) in an emergency, including to protect the safety of our employees or any person, or (d) in connection with investigating and preventing fraud.
 
We also aggregate data into anonymized system usage statistics. No individually identifiable information may be extracted from this data.

3. Data Security

We take commercially reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. Accordingly, we store all the personal information you provide on secure (password- and firewall-protected) servers which are located in Western Europe.
 
All electronic financial transactions entered into the MMT-System, App or Website will be protected by encryption technology.
 
You acknowledge, however, that no technical and organisational measures can fully eliminate security risks connected with the transmission of information over the internet. We therefore cannot guarantee the security of data sent over the internet.
 
You are responsible for keeping the account information (user name/password) for accessing the MMT-System confidential.

4. Data Retention and Deletion

We may retain information regarding you and your use of the MMT-System, including personally identifying information, for as long as needed to provide you with our services and the uses described in this Privacy Policy. Generally this means that we will keep information for the duration of your account.
 
If you choose, you may delete your account and the data connected therewith directly via the App. You may export your data before deleting your account. Such data export is in your sole responsibility and MMT is not obliged to provide any further assistance in connection with such export.
 
While MMT strives to provide the possibility of a full deletion of personal data, note that any information that we have copied may remain in back-up storage for some period of time[CKE1] after your account deletion.
 
Irrespective of your account deletion, we may in any event retain and use such data as necessary to comply with our legal obligations, maintain accurate accounting, financial and other operational records, resolve disputes, and enforce our rights connected to your use of the MMT-System.

5. Cookies

5.1. General

We may use "cookies" on the Websites. A cookie is a piece of data stored on a site visitor's hard drive to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site. Usage of a cookie is in no way linked to any personally identifiable information on our site. You can configure your browser to display a warning before cookies are saved. You can also choose to deactivate cookies in your browser. If you do so, you may not be able to use certain services on the Websites.

5.2. Google Analytics

We use Google Analytics, a web analytics service provided by Google, Inc., Mountainview, USA (“Google”) Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States.
 
Google will use the information collected for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing them other services relating to website activity and internet usage.
 
The IP-address that your browser conveys within the scope of Google Analytics will not be associated with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You can also opt-out from being tracked by Google Analytics with effect for the future by downloading and installing Google Analytics Opt-out Browser Addon for your current web browser (http://tools.google.com/dlpage/gaoptout?hl=en).

6. Requests for Information

If you have any questions or concerns regarding this privacy policy or MMT's use of your data you may address any queries to privacy@mmt.ch.
 
You may submit a written request to us together with a piece of personal identification (copy of ID-Card or Driver's License) to:
  • inquire what data we have about you, if any; or
  • change/correct any data we have about you; or
  • have us delete any data we have about you (although we may retain any data subject to a legal retention requirement and for the duration of the mandatory retention period); or
  • express any concern you have about our use of your data.

7. Privacy Policy Validity and Updates

This Privacy Policy is effective as of April 19, 2016. We reserve the right to update this Privacy Policy from time to time. Updates and their validity date will be included in this Section.
